(HARRISBURG, Pa., Nov. 17) — President Trump has signed a bipartisan funding bill that ends the proliferation of unregulated, synthetic intoxicating hemp products nationwide — closing the loophole that fueled their rapid spread across states like Pennsylvania.
Because the ban won’t take effect for 365 days, Pennsylvania lawmakers must act now to curb the unchecked spread of unregulated, untested, and frequently mislabeled intoxicating hemp products that continue to target minors.
What began as a loophole has grown into a public health and consumer safety crisis. These products — often mislabeled, easy for minors to purchase, and sold outside any licensed system — have proliferated in gas stations, smoke shops, and online retailers. The federal government has now responded decisively.
Pennsylvania Risks Being Left Behind
Pennsylvania is one of only 10 states that has not passed legislation addressing synthetic intoxicating hemp THC products. States must enact clear legislation for any product capable of causing intoxication, including synthetic THC products.
Unfortunately, an analysis from Villanova’s School of Business shows Pennsylvania already has a booming unregulated intoxicating hemp THC market:
- Nearly 40% of Pennsylvanians have accessed intoxicating hemp products
- 87% incorrectly believe these products are regulated
This unregulated intoxicating hemp THC market creates safety risks for consumers and deprives the Commonwealth of revenue that could support schools, infrastructure, and public safety.
